| Personal Injury Wavier: Member/Guest represents that he/she is 18 years of age or older (or 14 years of age with written parental consent), in good physical condition, and able to use the equipment provided and to participate in exercises and fitness programs made available by the Odyssey. Odyssey Fitness represents that its personnel have no expertise in diagnosing, examining, or treating medical conditions of any kind or in determining the effect of any specific exercise on said medical condition. Member/Guest is hereby informed and acknowledges that he/she is aware that risks and perils are inherent in sports and fitness activities such as those being conducted at Odyssey, and that when participating in any one or more of the fitness programs, or using the facilities maintained by Odyssey, there is the possibility of accidental or other personal injury to the member. Being fully aware that such risks exist, in consideration of acceptance as a member/guest of Odyssey, member/guest agrees to assume the risk of any such injury and agrees to indemnify and hold the Odyssey harmless for and from any and all costs or expenses of any kind whatsoever, including by way of illustration and not by way of limitation, to either the member or a third party, as a result of the use by the member/guest of the facilities and or/instructions offered by Odyssey Fitness. |
